Karizma Pointage — Terms of use
Employee time clock on the phone — Android
In short. Karizma Pointage replaces the time clock: you punch from your phone approved by your employer, which receives your punches. Always punch for yourself, at the real time.
1. Purpose
These terms govern the use of the Karizma Pointage app (Android), published by Karizma Conseil. It lets the employees of Karizma's client companies record their clock-ins and clock-outs from their phone instead of a time clock; the records are sent to the employer's management system.
2. Access and device
- Access is reserved for employees with an account provided by their employer, a client of Karizma. The app is free for the employee.
- Each phone must be approved by an administrator of the employer, who can revoke it at any time. You keep your credentials and your phone lock confidential, and you tell your employer without delay if the phone is lost.
3. Punches
- Each punch records the time and, depending on the employer's settings, a photo, the phone's location or a badge reading. They serve as proof of the punch; they are sent to the employer, which uses them under its own rules and labour regulations.
- Offline, punches are kept on the phone and sent as soon as the network returns. Hours, absences and any corrections are your employer's responsibility: questions about a punch go to your employer.
4. Permitted use
You punch for yourself, at the real time and place of your arrival or departure. In particular, it is forbidden to punch for a colleague, to fake the location or time, to use a photo that is not yours, or to try to bypass the security or disrupt the service.
5. Personal data
The data processed, why, who receives it, how long it is kept and your rights (law 09-08) are described in the privacy policy of Karizma Pointage, which is part of these terms.
6. Availability and changes to the service
Karizma works to keep the service available at all times but cannot guarantee it: interruptions may happen for maintenance, updates or incidents. Karizma may change, add or remove features; an app update may be needed to keep using it.
7. Liability
Karizma is liable for direct damage caused by a proven breach of its obligations. Karizma is not liable for the working-time rules applied by the employer, for the employer's decisions, or for the consequences of a use of the app contrary to these terms or of a failure of your phone (battery, network, location turned off).
8. Intellectual property
The app, its texts, code, brand and logo belong to Karizma Conseil. You receive a personal, non-exclusive, non-transferable right to use it, limited to the use set out in these terms. Copying, modifying, decompiling or reselling the app is not allowed.
9. Ending use
Your access ends when your employer removes it or revokes your phone. You can delete the app at any time; for the data processed by Karizma, write to support@karizma.ma.
10. Changes to these terms
Karizma may change these terms, in particular when new services open. The version in force is published on this page with its date. Significant changes are announced in the app before they apply; continuing to use the app means accepting the new version.
11. Governing law and disputes
These terms are governed by Moroccan law. Failing an amicable settlement, any dispute falls under the competent courts of Casablanca, without prejudice to the mandatory consumer protection rules of your country of residence.
