KARIZMA PAY MERCHANT APP

Karizma Pay Commerçant — Terms of use

App of the shops — iPhone and Android

In short. The shop issues and sells its own gift cards, under its responsibility; Karizma provides the tool to sell and take them. No payment goes through the app.

1. Purpose

These terms govern the use of the Karizma Pay Commerçant app (iPhone and Android) and of the related merchant space, published by Karizma Conseil. They let a shop in Morocco sell its own gift cards and take them in its stores, from the phones of its sellers.

2. Shop account and phones

  • The account is opened in the shop's name by a person authorised to commit it, who guarantees that the information given (company name, ICE, contact details) is accurate.
  • The shop pairs its phones from the merchant space and gives each one a role and rights. It remains responsible for what is done from its phones, for their security and for removing a lost phone or a seller who has left.

3. The shop's gift cards

  • The cards sold with the app are issued by the shop, in its own name and under its sole responsibility: price, validity, terms of use, exchange or refund, and the legal and tax obligations attached to them.
  • The price of the card is collected by the shop at the counter with its usual means. The app contains no payment feature: it records the card, its balance and its uses, and no money moves through it.
  • The shop hands the card number and secret code, shown only once, to the customer and informs the customer of the card's terms. Karizma is not a party to the sale between the shop and its customer.

4. Permitted use

The app is used only to sell and take the shop's gift cards. In particular, it is forbidden to take a card without its holder's code, to commit fraud, to use the app for an unlawful activity, or to try to bypass the security or disrupt the service. Karizma may suspend an account or a phone used against these terms.

5. Personal data

The data processed, why, who receives it, how long it is kept and your rights (law 09-08) are described in the privacy policy of Karizma Pay Commerçant, which is part of these terms.

6. Company cards (planned)

A later version will let the shops that wish also take the gift cards that companies give to their employees, paid on a payment account offered with Chari Money, a payment institution licensed by Bank Al-Maghrib, once Bank Al-Maghrib has authorised this service. That service will be governed by its own terms, accepted before it opens.

7. Availability and changes to the service

Karizma works to keep the service available at all times but cannot guarantee it: interruptions may happen for maintenance, updates or incidents. Karizma may change, add or remove features; an app update may be needed to keep using it.

8. Liability

Karizma provides a software tool and is liable for direct damage caused by a proven breach of its obligations. Karizma is not liable for the shop's commitments to its customers under the cards it issues, nor for the consequences of a use of the shop's phones contrary to these terms.

9. Intellectual property

The app, its texts, code, brand and logo belong to Karizma Conseil. You receive a personal, non-exclusive, non-transferable right to use it, limited to the use set out in these terms. Copying, modifying, decompiling or reselling the app is not allowed.

10. Deleting the account

An administrator phone can ask for the deletion of the shop's account in the app (Account › Delete the merchant account); without a paired phone, the request is made to support@karizma.ma. Cards still valid are settled with the shop before deletion, as described in the privacy policy.

11. Changes to these terms

Karizma may change these terms, in particular when new services open. The version in force is published on this page with its date. Significant changes are announced in the app before they apply; continuing to use the app means accepting the new version.

12. Governing law and disputes

These terms are governed by Moroccan law. Failing an amicable settlement, any dispute falls under the competent courts of Casablanca, without prejudice to the mandatory consumer protection rules of your country of residence.
